Is this the first example of brand/image misappropriation in Australia? Are there any legal precedents? Does the Indian Federal government care? Does the Haryana State Government care?
Personally, I think the framers of Australia's site-blocking laws were too myopic to see beyond the well-illuminated copyright violations. And I agree with the critics mentioned that maybe this kerfuffle is not about copyright.
BUT, this does illustrate that we are now members of a border-free economy, and we need to develop good relationships with our geographical neighbours, to combat what appears to be very dodgy advertising. It behooves us to ask the 2000yo question: "And who is my neighbour?" The answer will not please some people.
And for the time being, I think Simonds Homes will have to suck it up until what passes for government in Australia sorts a very sticky mess.
