NBN Co submitted a variation to its SAU to the ACCC for its consideration on 27 May 2016. On 20 July 2016 the ACCC published a position paper.commenting on NBN's proposed variation to the SAU:

Of particular interest to me are NBN's plans revealed in the SAU variation to change the amount and type of information it provides on its progress. It proposes to restrict essentially all of its detailed project progress information to "access seekers" - essentially companies planning to buy NBN services and retail these to the public - on the grounds of "commercial in confidence". Hence most detailed progress information will not be made available to the public anymore. I urge all readers to have a look at NBN's proposed SAU variation and the ACCC's consultation paper, and make a submission to the ACCC if you can. This may be our last chance to try to force the NBN to be more transparent. We have until 26 August to comment.
